1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Mentius ("we", "us", or "our") concerning your access to and use of the Mentius mobile and web applications (the "App"). By downloading, installing, or accessing the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Nature of the Service (Non-Medical Wellness Platform)

Mentius is a digital cognitive fitness, emotional awareness, and mental resilience training platform. The App provides gamified mental exercises, psychometric self-reflection questions, biofeedback pacing routines, and lifestyle habit tracking designed strictly for general wellness, recreational personal growth, and cognitive optimization.

Mentius is NOT a medical device, diagnostic tool, clinical therapy service, or healthcare provider.

3. Eligibility & Age Restriction

You must be at least 18 years of age (or the age of legal majority in your country of residence) to create an account and use the App. Individuals under 18 may only use the App under the direct supervision and consent of a parent or legal guardian.

4. Acceptable Use & Safety Warnings

Physical Safety: Do not conduct biofeedback measurements, breathwork exercises, or cognitive focus sprints while driving, operating heavy machinery, cycling, or in any environment where distracted attention could cause physical danger.
Prohibited Conduct: You agree not to decompile, reverse-engineer, modify, exploit, or scrape the App, its backend APIs, or proprietary algorithm pipelines.

5. Intellectual Property Rights

The Mentius brand, the M◆ monogram, the MENTIUS wordmark, user interface designs, custom mathematical scoring algorithms, audio assets, and proprietary sprint methodologies are the exclusive intellectual property of Mentius.

6. Subscriptions, In-App Purchases & Billing

Certain enhanced tiers ("Mentius Premium") may require a recurring subscription or in-app purchase. All purchases are processed securely through Google Play Billing or Apple App Store (StoreKit). Subscriptions automatically renew unless cancelled at least 24 hours prior to the end of the current billing cycle.

For iOS users, these Terms incorporate by reference the Apple Standard End User License Agreement (EULA).

7. Disclaimer of Warranties & Limitation of Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the maximum extent permitted by applicable law, Mentius shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from your use of or inability to use the App.
